Your personal rights are important to QyberTex UG and worth protecting. This Privacy Policy describes how we collect, use, disclose, and store personal data. If you have any questions, please contact us at service@qybertex.de.

  3. Scope of this Privacy Policy

    This Privacy Policy describes the data protection practices for all websites, the online shop, the web portal, and smartphone apps of QyberTex UG. It does not extend to any linked third-party websites.

    Use of our websites generally does not require any personal data. When using the ordering process in our online shop, as well as our services in the web portal and in apps, we process the personal data required for contract performance on the legal bases stated in this Policy.

    Insofar as our offering provides the option to enter personal or business data (name, address, email address, telephone number), this is done, unless otherwise stated, on a voluntary basis. This data will not be passed on to third parties without a legal basis for doing so.

    By using the products, websites, and apps of QyberTex UG, this Privacy Policy as well as our Terms and Conditions apply. When using our web portal, the further terms of use and the Data Processing Agreement also apply.

  4. Collection of Personal Data

    Ordering Process, Registration, and Customer Service

    If you register on one of our websites, in the online shop, in our web portal, or in another application of QyberTex UG, or contact our customer service for support or information about our offerings, we collect the data required to identify you. This may include your name, company name, address, telephone number, email address, payment information, and IP address.

    In some cases, we also collect information that does not relate to an identified person, such as which products and applications you are interested in. Some of this information is required, other information is voluntary. The legal basis is Art. 6 (1)(b) GDPR (performance of a contract or pre-contractual measures).

    Use of Our Websites, Web Portal, Online Shop, and Apps

    We collect technical information about the use of our services and websites in server log files in order to detect attacks on our systems and to ensure the stability and security of our services. This includes, for example, the time of the server request and the type of browser and device used. The legal basis is our legitimate interest in the secure and functional operation of our systems (Art. 6 (1)(f) GDPR).

    Use of Services in Our Web Portal and Apps

    When using our web portal, you have the option to enter information about your customers for the purpose of using our services (e.g. contact management, consulting and marketing tools). For the use of the web portal, we enter into a Data Processing Agreement with you pursuant to Art. 28 GDPR; details can be found on our "Data Processing Agreement" page.

    Contact Form

    If you use a contact form on our website to get in touch with us, we store your request and the contact details you provided for processing and in case of follow-up questions. The legal basis is Art. 6 (1)(b) or (f) GDPR.

  5. How We Use Personal Data

    Personal data is used only within the scope of the purposes and legal bases stated in this Policy (in particular Art. 6 (1)(b) and (f) GDPR):

    • Processing orders, providing software licenses and services, and processing payment.
    • Individually tailoring your user experience and providing curated information.
    • Improving our platform, and preventing and detecting misuse and fraud.
    • Enabling third parties engaged by us to provide technical, logistical, or other services.
    • Authorization and authentication when using the digital products and services of QyberTex UG.
  6. Integration of Third-Party Services and Content

    Third-party content, such as YouTube videos, RSS feeds, or graphics from other websites, may be embedded within this online offering. This always requires the providers of this content (hereinafter "third-party providers") to become aware of the user's IP address, since without it they could not send the content to the respective user's browser. We endeavor to use only content whose providers use the IP address solely for the purpose of delivering the content; we have no influence over any use by third-party providers beyond this.

    Our services, portals, websites, products, and applications may contain links to websites, products, and services of other companies. Data collected by these third parties is subject to their own data protection practices. We recommend that you inform yourself about the data protection practices of these companies.

  7. Disclosure to Third Parties

    Your data is generally not disclosed to third parties. This only occurs on the basis of legal requirements or where you have authorized us to do so. QyberTex UG only discloses your data to third parties where this is necessary for the provision of the products and services you use.

    Third-party services include, for example, the processing of payment information, fulfillment of customer orders, provision of customer service, and conducting customer satisfaction surveys. These companies are contractually obligated to protect your personal data.

    It may occasionally be necessary for QyberTex UG to disclose personal data due to statutory provisions, legal proceedings, litigation, and/or requests from authorities.

  8. Log Files, Server Logs, and Cookies

    When you visit our website and use our services, certain technical data is automatically collected and stored in log files, including IP address, browser type and language, date/time stamps, and the page accessed. The legal basis is our legitimate interest in the security and stability of our systems (Art. 6 (1)(f) GDPR).

    Our online shop uses cookies that are technically necessary for the operation of the website, e.g. to manage your shopping cart or your login session. These cookies do not require consent (Section 25 (2) No. 2 of the German Telecommunications and Telemedia Data Protection Act (TTDSG), Art. 6 (1)(b) GDPR).

    For cookies that are not technically necessary (e.g. analytics or marketing cookies), we obtain your consent in advance via a cookie consent banner (Art. 6 (1)(a) GDPR, Section 25 (1) TTDSG). We currently do not use any such cookies.

    You can prevent the setting of cookies by adjusting your browser settings accordingly; this may limit the functionality of our website.

  9. Google Web Fonts

    We use Google Web Fonts on our websites and in the web portal for a consistent display of typefaces. The font files are hosted locally by us; when you visit our pages, no connection is made to Google's servers and no data is transmitted to Google.

  10. Protection of Personal Data

    QyberTex UG takes precautions — including administrative, technical, and physical measures — to protect personal data against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction.

    Our online services use an encrypted connection (TLS/SSL) on all pages where personal data is collected. To use these services, you need a browser that supports an encrypted connection. If you post personal data in a forum, chat room, or social network, this data is visible to other users; you are solely responsible for the data you enter there.

  11. Integrity and Retention of Personal Data

    We retain personal data for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

  12. User Obligations

    As a user of our services, you are responsible for ensuring that all data protection requirements and consents necessary for the contractual provision of the service are in place with regard to any third-party personal data you enter (e.g. customer addresses, customer phone numbers, or order data).

    We expressly point out that, according to the current state of technology, data protection during transmission over open networks such as the internet cannot be fully guaranteed. QyberTex UG implements all reasonable measures to prevent unauthorized third-party access to stored data.

  13. Your Rights as a Data Subject

    Under the GDPR, you have, in particular, the following rights, which you may assert against us subject to the statutory requirements:

    • Right of access to the personal data we process about you (Art. 15 GDPR)
    • Right to rectification of inaccurate data (Art. 16 GDPR)
    • Right to erasure of your data (Art. 17 GDPR)
    • Right to restriction of processing (Art. 18 GDPR)
    • Right to data portability (Art. 20 GDPR)
    • Right to object to processing (Art. 21 GDPR)
    • Right to withdraw any consent given, with effect for the future (Art. 7 (3) GDPR)

    Independently of this, you have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), in particular in the member state of your habitual residence, place of work, or the place of the alleged infringement.

    If you have any questions or concerns about this Privacy Policy or the processing of data by QyberTex UG, please contact us at service@qybertex.de.

    We keep this Privacy Policy up to date. We therefore reserve the right to amend it in the event of legal and/or technical requirements or for reasons of clarification. Please refer to the current version of this Privacy Policy at all times.
